Who should apply for STEM OPT — and who should not

STEM OPT is a training extension, not a general work permit. It only makes sense when your degree appears on the DHS STEM Designated Degree Program list, your employer is enrolled in E-Verify, and the role is directly related to your field of study. If any of those three pillars is weak, filing I-765 for STEM OPT usually wastes filing fees and calendar time that should go toward a different pathway.

Students on regular post-completion OPT should start the STEM conversation 90–120 days before their current EAD ends. That window is what you need for the I-983 training plan, DSO recommendation, and USCIS receipt notice — not the full adjudication. Cap-gap and H-1B timing interact with STEM OPT: a well-timed extension can preserve multiple lottery seasons without unauthorized employment.

  • Confirm CIP code / major appears on the current STEM list before you ask HR for I-983 signatures.
  • Employer must use E-Verify for the hiring worksite — not a vague “we use E-Verify somewhere.”
  • Part-time or unpaid training rarely satisfies STEM OPT employment rules; document hours and duties.
  • Self-employment and startups are high-risk unless ownership, supervision, and training structure are crystal clear.

I-983 and reporting: the compliance layer students skip

The Form I-983 is the compliance backbone of STEM OPT. USCIS and your DSO expect learning objectives, evaluation checkpoints, and employer attestations that the training will not replace a U.S. worker. Thin I-983s that restate a job title without skill progression are a common refusal and SEVIS flag pattern.

After approval, STEM OPT requires more than annual address updates. You must complete self-evaluations on the I-983 schedule and validate employment at six-month intervals. Changing employers means a new I-983, a DSO update, and careful unemployment-day tracking — the 150-day STEM unemployment cap is separate from the 90-day regular OPT cap and both matter for status maintenance.

Document package that actually survives review

A durable STEM OPT package includes: passport biographic page, current EAD, most recent I-20 with STEM recommendation, final transcript or diploma evidence, I-983 fully signed, and a cover letter mapping the job duties to your degree. If your job title is generic (“analyst,” “associate”), expand the duty description until a non-specialist can see the STEM skill connection.
